1. Our website is made available and accessible to you in accordance with the Terms of Use and Services, together with the privacy policy (collectively the “TOS”) as posted on our website. Hypenation PLT is a company registered in Kuala Lumpur, Malaysia. By visiting our website, you are deemed accepting and consenting to the practices as described in the TOS, which may be modified or changed from time to time when it is deemed necessary.


2. If you are under the age of 18, you must let your parent or guardian know about the TOS before you register to use our website or any of our website’s services. We reserve our right to only accept registration and/or order from those age 18 and above. If you do not agree to any of the TOS, you shall immediately stop visiting or using our website.

REGISTRATION

1. In order for us to process your order, you are required to register with us and you are warranting us that all your personal information provided to us is true, accurate, complete and up to date in all respects. If any of your personal information changes, you must notify us as soon as possible at cs@hijutori.com. We may also change the requirements of registration from time to time when it is deemed necessary.


2. You shall not represent yourself as anyone else that you are not authorised to use. The account password that you have created shall be kept secured and confidential and notify us immediately of any breach of security or unauthorised use of your account. Hypenation PLT will not be held liable for any unauthorised use of your account or losses caused by such act.

PURCHASING

1. When you place an order through our website, you must provide us the true, accurate and up to date information such as your name, email address, shipping address, credit/debit card details and other information we may require from you. You are also warranting us that you are at least 18 years of age and have the capacity to enter a legal binding contract.


2. We reserve the right not to accept your order due to the following :-
   1. Non availability of product in our stock; or
   2. You do not fulfil the requirements as described in the TOS; or
   3. There is an error of pricing or identification of product; or
   4. We are not able to obtain authorisation of your payment.


3. The contract between you and us will be fulfilled upon sending your items for dispatch, in which you will be notified by email to confirm that your item has been dispatched.

PRODUCT DESCRIPTION & COLOURS

1. While we take great care and make every effort to ensure the descriptions and colours of our product shown on our website look as accurate as possible, we cannot guarantee there will not be discrepancies. The descriptions of product may vary and the colours representation depends on your computer screen and/or individual’s colour setting.

PRICING AND PAYMENT POLICY

1. All prices shown on our website are in Ringgit Malaysia (RM), subject to change from time to time without prior notice and exclusive of cost of delivery. The price indicated at the time of purchase which has been accepted by us will be not be changed.


2. We accept payment via credit card or debit card. By placing order with us, you confirm that the credit card or debit card used is yours or you have obtained permission from the owner of the credit card or debit card. If your bank or card issuer denies payment to us, we will not be liable for any cancellation.


3. If you are ordering from outside of Malaysia, we suggest that you check with relevant sources/authorities before completing your order as you may need to pay for import duties and/or taxes and/or customs charges imposed when the delivery reaches the country from which you are ordering. We will not be held responsible for these payments. The total amount will be calculated by using the exchange rate on the day when your bank or card issuer processes your purchase.


4. While we take every reasonable effort and care to make our website safe and secure for our customers, we cannot be held liable for losses suffered by you for fraudulent use on our website. However, we will assist your bank or card issuer as best as possible when there is fraud reported to them.

WEBSITE USE AND THIRD PARTY

1. This website is solely for your personal non-commercial use. By using our website, you agree that you will only use it for lawful purposes and you are not allowed to modify, copy, publish, share, distribute or remove its content. We hold discretion and reserve the right to deny you the access to our website without prior notice.


2. We cannot be held liable for any content made available on any third parties/external websites linked or referred to on our website. We have no control over these third parties/external websites and as such, we cannot be held liable for any loss and/or damage caused in any way by them. The use of these third parties/external websites is entirely at your own risk.

INTELLECTUAL PROPERTY RIGHTS

1. All contents, including copyright and anything displayed on this website are owned by Hypenation PLT, which may be altered, changed and updated from time to time. Your access and use of our website is solely for your personal use and not for any commercial use. You have no rights in relation to the contents which include any designs, copyright, trademark and other intellectual property and material rights relating to our website. Unlicensed used of any of the contents is prohibited and we reserve the right to take legal action against such usage.

GENERAL

1. In the event a force majeure occurs, our contract shall be suspended for a period of time which is equivalent to the period of the force majeure, to allow us to deliver our contract obligations. If we are unable to fulfil our contract obligation due to force majeure, we will notify you and we will refund your purchase monies. Force majeure means an event that occurs which is beyond our control such as war, strikes, riots, lockdown, pandemic, disruption of transport system and any other possible situations which prevent us from fulfilling our contract obligation.


2. We reserve the right to assign the contract between us pursuant to the TOS to a third party which include our obligations under the contract. If we do so, we will notify you.


3. We cannot guarantee that our website will always remain accessible, free from viruses or other hindrances at all times which are out of our control. We cannot be held liable for any loss of content or material uploaded or transmitted through our website.


4. We do not give any warranty in relation to the products available on our website of satisfactory quality and/or fitness.


5. The contract created between us pursuant hereto shall be governed by and under the laws of Malaysia.
